Following and extending Searle’s speech act theory, both Pragma-Dialectics and the Linguistic Normative Model of Argumentation characterize argumentation as an illocutionary act. In these models, the successful performance of an illocutionary act of arguing depends on the securing of uptake, an illocutionary effect that, according to the Searlean account, characterizes the successful performance of any illocutionary act. However, in my view, there is another kind of illocutionary effect involved in the successful performance of an illocutionary act of arguing, which affects (...) both the speaker’s and the hearer’s set of rights, obligations, and entitlements. In order to give an account of this second type of effect, I will argue that it is necessary to distinguish two levels in the analysis of the illocutionary act of arguing. The first one is related to the illocutionary effect of securing of uptake and thus to the speech act performed by the speaker, while the second one allows us to account for the changes produced by the performance of the illocutionary act of arguing in the deontic modal competence of both the speaker and the hearer. It is becoming increasingly clear that repetitive DNA is of biological significance as well as experimental importance. Here we review the information available about one type of repetitive DNA, the trinucleotide repeat (CAC)n, and briefly compare it with other trinucleotide repeats. Although much work has been done in analysing DNA fingerprinting patterns produced using the synthetic oligonucleotide (CAC)5 as a probe, there is relatively little information about individual (CAC)n‐containing sequences and their abundance, organisation and distribution in mammalian DNA. From the (...) data that is available, it is clear that there are at least two areas that should repay further study: (1) the organisation and generation of long sequences that contain (CAC)n motifs as part of a larger repeating unit (minisatellites) and (2) the distribution of small (CAC)n sequences (microsatellites), in particular their relationship to genes. Companies that are serious about corporate governance and business ethics are turning their attention to gender diversity at the most senior levels of business . Board gender diversity has been the subject of several studies carried out by international organizations such as Catalyst , the World Economic Forum , and the European Board Diversity Analysis . They all lead to reports confirming the overall relatively low proportion of women on boards and the slow pace at which more women are being (...) appointed. Furthermore, the proportion of women on corporate boards varies much across countries. Based on institutional theory, this study hypothesizes and tests whether this variation can be attributed to differences in cultural settings across countries. Our analysis of the representation of women on boards for 32 countries during 2010 reveals that two cultural characteristics are indeed associated with the observed differences. We use the cultural dimensions proposed by Hofstede to measure this construct. Results show that countries which have the greatest tolerance for inequalities in the distribution of power and those that tend to value the role of men generally exhibit lower representations of women on boards. Assim, o objetivo é identificar como os agentes de produções estão conectadas as agências na cidade de Duque de Caxias e como articulam as produções para projetação e divulgação de ações patrimoniais na cidade. The first studies that sought to establish two-way communication between humans and great apes led to important findings but were nevertheless heavily criticized for their training methods, testing procedures, and claims. More recently, hundreds of pet owners around the world have begun training domesticated animals to use Augmentative Interspecies Communication (AIC) soundboard devices, contributing to the first ever large-scale study on interspecies communication. Here, we introduce our scientific approach to our global citizen science project, where we will investigate how dogs (...) and cats use AIC devices, building an incremental research program starting from their associative learning of buttons to determining how AIC device use might impact their welfare and their capacity for symbolic representation. We discuss how our multi-faceted approach can alleviate many of the concerns regarding the original studies performed with apes, achieving larger sample sizes, ample documentation of training techniques, and testing animals’ performance in controlled experimental settings. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

ABSTRACT This article embarks upon a new journey that explores a mental geography or ambient atmosphere, where the encounter and relief amongst singular imaginaries allows one to trace a new cartography, one in which critical and decolonial thought may converge in a common horizon. Thus, undertaking anew the transit that leads from an insular reason to an archipelagic reason, by tracing the forms taken by the image of the island in different texts, is proposed. Accordingly, our point of departure will be the "island of understanding" in the Critique of Pure Reason, we will pass swiftly through Atlantis and The New Atlantis, then we will move on to "the desert island" and The island that repeats itself to finally land on The stranded island. A sizeable body of literature suggests that informal methods of dispute resolution — and, in particular, conciliation — flourish only in societies marked by extensive social hierarchy. Given this literature, it is quite surprising to discover that in the mid-nineteenth century, the United States embarked on an extensive debate regarding whether to adopt "conciliation courts," whose primary function was to reconcile the disputants by persuading them to embrace an equitable compromise. First created by the French Revolutionaries in 1790, conciliation courts (...) were widely established throughout continental Europe. Observing this development, leading American lawyers and politicians pondered seriously whether the United states ought to follow suit. Debate over whether to embrace such institutions occurred at the very highest of levels, and a series of states enacted constitutional provisions authorizing their legislatures to create conciliation courts. Ultimately, however, despite the widespread interest in such institutions, these were never established — except in the notable case of the Freedmen’s Bureau courts of the Reconstruction South. This Article explores this largely forgotten episode in American legal history. It examines why a nation that was radically egalitarian by standards of the time would seriously consider embracing an institution that we tend more commonly to associate with inegalitarian, strongly hierarchical societies — and why, after coming so close to adopting conciliation courts, it ultimately failed to do so. In the process, by situating the debate over conciliation courts in a broader social and legal context, the Article also excavates the origins of the modern, quintessentially American commitment to the virtues of formal, adversarial process. Devido ao contexto de pandemia de COVID-19, que perdurou durante quase todo o ano letivo de 2021, as atividades do Núcleo precisaram ser adaptadas para que ocorressem em ambientes virtuais. This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. Last, Part V discusses the relevance of empathy to our understanding of justice and legal morality. (shrink)

Studies have shown that students may feel emotional discomfort when they are asked to identify ethical problems which they have encountered during their training. Teachers in medical ethics, however, more often focus on the cognitive and rational ethical aspects and not much on students’ emotions. The purpose of this qualitative study was to explore students’ feelings and emotions when dealing with ethical problems during their clinical training and explore differences between two countries: Indonesia and the Netherlands. We observed a total (...) of eighteen ethics group discussions and interviewed fifteen medical students at two medical schools. Data were interpreted and analyzed using content analysis. We categorized students’ negative emotions based on their objects of reflection and came up with three categories: emotions concerning their own performance, emotions when witnessing unethical behaviors, and emotions related to barriers and limitations of their working environment. Our study suggests that addressing emotional responses in a culturally sensitive way is important to develop students’ self-awareness. Teachers should be able to guide students to reflect on and be critical of their own thoughts and emotions, to understand their own moral values, especially when confronted with other individuals. In this paper I develop a framework for relating dualities and emergence: two notions that are close to each other but also exclude one another. I adopt the conception of duality as 'isomorphism', from the physics literature, cashing it out in terms of three conditions. These three conditions prompt two conceptually different ways in which a duality can be modified to make room for emergence; and I argue that this exhausts the possibilities for combining dualities and emergence. I apply this (...) framework to gauge/gravity dualities, considering in detail three examples: AdS/CFT, Verlinde's scheme, and black holes. My main point about gauge/gravity dualities is that the theories involved, qua theories of gravity, must be background-independent. I distinguish two senses of background-independence: minimalistic and extended. I argue that the former is sufficiently strong to allow for a consistent theory of quantum gravity; and that AdS/CFT is background-independent on this account; while Verlinde's scheme best fits the extended sense of background-independence. I argue that this extended sense should be applied with some caution: on pain of throwing the baby out with the bath-water. Nevertheless, it is an interesting and potentially fruitful heuristic principle for quantum gravity theory construction. It suggests some directions for possible generalisations of gauge/gravity dualities. The interpretation of dualities is discussed; and the so-called 'internal' vs. 'external' viewpoints are articulated in terms of: epistemic and metaphysical commitments; parts vs. wholes. I then analyse the emergence of gravity in gauge/gravity dualities in terms of the two available conceptualisations of emergence; and I show how emergence in AdS/CFT and in Verlinde's scenario differ from each other. Finally, I give a novel derivation of the Bekenstein-Hawking black hole entropy formula based on Verlinde's scheme; the derivation sheds light on several aspects of Verlinde's scheme and how it compares to Bekenstein's original calculation. In this paper I shall address the connections between Deleuze and Guattari’s philosophy and Caribbean thought. However, I will only focus on Antonio Benítez Rojo’s essay The Repeating Island, since I have found in it the presence—or expression—of some key deleuzian and deleuzo-guattarian concepts. I will use the deleuzian concept of repetition to defend this stance, as well as to argue that one may find some of the most interesting readings of Deleuze’s texts in the work of Caribbean authors such (...) as Benítez Rojo, not only in spite of their relative understanding and lack of exegetical rigour, but rather thanks to the fact that this is, in no case, their main intention. The angle I have chosen does not intend to point out consistencies or inconsistencies in Benítez Rojo’s “appropriations” or “rewritings” of Deleuze and Guattari, for this would only keep us within the logic of the copy versus the original. Instead, this reading tries to destabilize the boundaries between philosophy and literature as well as between French and Caribbean thought. The undoing of these types of distinction intends to produce a new theatre of thought, a theatre of repetition, not of representation, in order to set up the scene for a contrapunteo between two images of thought: one deleuzian, the other Caribbean. Thus, we embark upon this journey hoping to have an encounter that promises yet another becoming to Deleuze’s philosophy. L’articolo intende approfondire la questione del Medioevo come luogo di narrazioni a partire dal romanzo di Louis De Wohl dedicato ad Agostino d’Ippona, _Una fiamma inestinguibile _ e dal tema della retorica. Il tema della retorica, come una delle dimensioni possibili in cui rappresentare la storia, dà vita sia a una peculiare narrazione _descrittiva_ del Medioevo, plurale e variegata, sia a una narrazione _creatrice_ della storia stessa, dal momento che la potenza della parola di Agostino viene colta nella sua capacità (...) di incidere e trasformare la storia stessa. Il contributo si conclude con l’analisi di alcuni tratti salienti di altri romanzi di ambientazione medievale di De Wohl, su Francesco d’Assisi e su Tommaso d’Aquino, per osservarne la peculiare rappresentazione di Medioevo che a tratti sembra andare oltre agli schemi storiografici degli anni in cui sono scritti. _The article intends to explore the question of the Middle Ages as a place of narrations starting from Louis De Wohl’s novel about Augustine of Hippo, _The Restless Flame_ and the theme of rhetoric. The subject of rhetoric, as one of the possible dimensions in which to represent history, gives rise both to a peculiar _descriptive_ narrative of the Middle Ages, plural and variegated, and to a narration that _creates_ history itself, since the power of Augustine’s word is captured in its ability to affect and transform history itself. The paper concludes with an analysis of some salient features of other medieval novels by De Wohl, on Francis of Assisi and Thomas Aquinas, in order to observe the peculiar representation of the Middle Ages that emerges, which at times seems to go beyond the historiographic schemes of the years in which they were written_. The essay outlines the debate around the question on the existence of Medieval Aesthetics starting from the publication of Arte e bellezza nell’estetica medievale by Umberto Eco. Since the last decade of the 20th century, the question on Medieval Aesthetics receives a particular attention from a methodological point of view also because it is close to different disciplines as History, History of Art, Aesthetics and History of Philosophy. A renewed interest in the image theme, in History and History of Art, (...) permits to study the pre-modern period without using anachronistic categories like that of “Art”. In the field of Aesthetics scholars rethink how to approach the question about its history. In this context, History of Philosophy reviews its own categories asking how it is possible to talk about thematic objects that traditionally belong to Aesthetics. (shrink)

Stigma against mental disability within the medical field continues to impose significant barriers on physicians and trainees. Here, we examine several implications of this stigma and propose steps toward greater inclusion of persons with mental disabilities in the physician workforce.

I conceptualise the role of dualities in quantum gravity, in terms of their functions for theory construction. I distinguish between two functions of duality in physical practice: namely, discovering and describing ‘equivalent physics’, versus suggesting ‘new physics’. I dub these the ‘theoretical’ versus the ‘heuristic’ functions of dualities. The distinction seems to have gone largely unnoticed in the philosophical literature: and it exists both for dualities, and for the more general relation of theoretical equivalence. The paper develops the heuristic function (...) of dualities: illustrating how they can be used, if one has any luck, to find and formulate new theories. I also point to the different physical commitments about the theories in question that underlie these two functions. I show how a recently developed schema for dualities articulates the differences between the two functions. (shrink)

In this essay I begin to lay out a conceptual scheme for: analysing dualities as cases of theoretical equivalence; assessing when cases of theoretical equivalence are also cases of physical equivalence. The scheme is applied to gauge/gravity dualities. I expound what I argue to be their contribution to questions about: the nature of spacetime in quantum gravity; broader philosophical and physical discussions of spacetime. - proceed by analysing duality through four contrasts. A duality will be a suitable isomorphism between models: (...) and the four relevant contrasts are as follows: Bare theory: a triple of states, quantities, and dynamics endowed with appropriate structures and symmetries; vs. interpreted theory: which is endowed with, in addition, a suitable pair of interpretative maps. Extendable vs. unextendable theories: which can, respectively cannot, be extended as regards their domains of application. External vs. internal intepretations: which are constructed, respectively, by coupling the theory to another interpreted theory vs. from within the theory itself. Theoretical vs. physical equivalence: which contrasts formal equivalence with the equivalence of fully interpreted theories. I will apply this scheme to answering questions - for gauge/gravity dualities. I will argue that the things that are physically relevant are those that stand in a bijective correspondence under duality: the common core of the two models. I therefore conclude that most of the mathematical and physical structures that we are familiar with, in these models, are largely, though crucially never entirely, not part of that common core. Thus, the interpretation of dualities for theories of quantum gravity compels us to rethink the roles that spacetime, and many other tools in theoretical physics, play in theories of spacetime. We advocate an account of dualities between physical theories: the basic idea is that dual theories are isomorphic representations of a common core. We defend and illustrate this account, which we call a Schema, in relation to symmetries. Overall, the account meshes well with standard treatments of symmetries. But the distinction between the common core and the dual theories prompts a distinction between three kinds of symmetry: which we call ‘stipulated’, ‘accidental’ and ‘proper’.

In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis (...) of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making. In this paper we present a schema for describing dualities between physical theories, and illustrate it in detail with the example of bosonization: a boson-fermion duality in two-dimensional quantum field theory. The schema develops proposals in De Haro : these proposals include construals of notions related to duality, like representation, model, symmetry and interpretation. The aim of the schema is to give a more precise criterion for duality than has so far been considered. The bosonization example, or boson-fermion duality, (...) has the feature of being simple, yet rich enough, to illustrate the most relevant aspects of our schema, which also apply to more sophisticated dualities. The richness of the example consists, mainly, in its concern with two non-trivial quantum field theories: including massive Thirring-sine-Gordon duality, and non-abelian bosonization. This prompts two comparisons with the recent philosophical literature on dualities:--- Unlike the standard cases of duality in quantum field theory and string theory, where only specific simplifying limits of the theories are explicitly known, the boson-fermion duality is known to hold {\it exactly}. This exactness can be exhibited explicitly. The bosonization example illustrates both the cases of isomorphic and {\it non-isomorphic} models: which we believe the literature on dualities has not so far discussed. (shrink)

We discuss some aspects of the relation between dualities and gauge symmetries. Both of these ideas are of course multi-faceted, and we confine ourselves to making two points. Both points are about dualities in string theory, and both have the ‘flavour’ that two dual theories are ‘closer in content’ than you might think. For both points, we adopt a simple conception of a duality as an ‘isomorphism’ between theories: more precisely, as appropriate bijections between the two theories’ sets of states (...) and sets of quantities. The first point is that this conception of duality meshes with two dual theories being ‘gauge related’ in the general philosophical sense of being physically equivalent. For a string duality, such as T-duality and gauge/gravity duality, this means taking such features as the radius of a compact dimension, and the dimensionality of spacetime, to be ‘gauge’. The second point is much more specific. We give a result about gauge/gravity duality that shows its relation to gauge symmetries to be subtler than you might expect. For gauge theories, you might expect that the duality bijections relate only gauge-invariant quantities and states, in the sense that gauge symmetries in one theory will be unrelated to any symmetries in the other theory. This may be so in general; and indeed, it is suggested by discussions of Polchinski and Horowitz. But we show that in gauge/gravity duality, each of a certain class of gauge symmetries in the gravity/bulk theory, viz. diffeomorphisms, is related by the duality to a position-dependent symmetry of the gauge/boundary theory. This paper examines the concept of coherence and its role in legal reasoning. First, it identifies some problem areas confronting coherence theories of legal reasoning about both disputed questions of fact and disputed questions of law. Second, with a view to solving these problems, it proposes a coherence model of legal reasoning. The main tenet of this coherence model is that a belief about the law and the facts under dispute is justified if it is “optimally coherent,” that is, if (...) it is such that an epistemically responsible legal decision-maker would have accepted it as justified by virtue of its coherence in like circumstances. Last, looking beyond the coherence theory, the paper explores the implications of the version of legal coherentism proposed for a general theory of legal reasoning and rationality. (shrink)

This paper argues that formal models of coherence are useful for constructing a legal epistemology. Two main formal approaches to coherence are examined: coherence-based models of belief revision and the theory of coherence as constraint satisfaction. It is shown that these approaches shed light on central aspects of a coherentist legal epistemology, such as the concept of coherence, the dynamics of coherentist justification in law, and the mechanisms whereby coherence may be built in the course of legal decision-making.

This essay is devoted to Albert the Great’s theoretical treatment of fatherhood and motherhood, male and female genders, in the generation of the vegetabilia. While animals reproduce by the mating of female and male individuals, plants do not display a sexual distinction through a male and female configuration. Moreover, in the generation of plants, the maternal and paternal functions are not performed by individuals of the same species as what is generated. To fulfill the generative process, plants require the external (...) agency of the Sun and the ground, traditionally deemed as “pater et mater plantarum”. The question of the generation of plants is dealt with at length in Albert’s De vegetabilibus et plantis, where he gives an extensive treatment of plants’ life modeled after the epistemology of Aristotle’s works on animals. This theoretical approach is not confined to Albert’s natural philosophical works but extends also to his theological investigation. By adopting an interdisciplinary standpoint, this essay will show how Albert progressively develops an explicative model for plants generation that, through the comparison with animal generation, aims at identifying the respective domains of matter and form, fatherhood and motherhood, male and female genders, also in the generation of plants. This article engages new histories of the black frontline communities of the Underground Railroad to rethink both fugitive democracy and the transformative possibilities of sanctuary as its constitutive twin. We analyze the ways that communities of free blacks and fugitives in the border zones between the Antebellum US North and South crafted themselves as magnetic spaces of creative refuge that suggest we reconceive sanctuary as the generative twin of fugitivity. This insight enables us to theorize new ethical and political dimensions (...) of Sheldon Wolin’s concept fugitive democracy by illuminating how fugitivity as flight away from danger can be interwoven with sanctuary as flight into and toward alternatives. Specifically, we theorize three dimensions of fugitive democracy/transformative sanctuary—sanctuary tending, dramatic sanctuary, and disruptive hospitality. While some theorists have considered key motifs in Wolin’s fugitive democracy to be opposed to vital themes disclosed in contemporary theories of black fugitivity, we argue that the power of black frontline communities stemmed precisely from their capacities to dynamically entangle political approaches taken to be at odds. For example, we suggest a theory and practice of tending involving both nurturing care and militantly defensive action, dramatic sanctuary performances that amplify public power by oscillating between tricky concealment and flagrant publicity, and disruptive hospitality that interweaves law-breaking harbor with strategies for juridical and institutional change. These insights open onto an alternative imaginary that can also provide a toolbox for building grassroots democratic power today, particularly in the face of emergent neofascism and escalating displacement worldwide. We argue that dualities offer new possibilities for relating fundamentality, levels, and emergence. Namely, dualities often relate two theories whose hierarchies of levels are inverted relative to each other, and so allow for new fundamentality relations, as well as for epistemic emergence. We find that the direction of emergence typically found in these cases is opposite to the direction of emergence followed in the standard accounts. Namely, the standard emergence direction is that of decreasing fundamentality: there is emergence of less (...) fundamental, high-level entities, out of more fundamental, low-level entities. But in cases of duality, a more fundamental entity can emerge out of a less fundamental one. This possibility can be traced back to the existence of different classical limits in quantum field theories and string theories. (shrink)
